- Brownfields applications: In October 2003, New York adopted its own Brownfields Law which provides credits and other incentives to parties to take title to contaminated properties. While the state recently modified the Brownfields Law, the Law continues to offer a significant benefit to volunteers who will only have to clean up the four corners of the property and not chase the plume off-site. We help potential purchasers of Brownfield sites understand eligibility requirements for the Brownfields Program and assists those who qualify submit their applications.
- Assistance with environmental cleanups: Our firm can help you interface with your environmental remediation company and the regulatory agency that has jurisdiction over your environmental cleanup project. With our guidance, we will ensure, to the extent practicable, that the clean up is done in a cost-effective manner.
- Environmental insurance claims - Was your property contaminated by the release of petroleum from a third party, such as a petroleum delivery company? If so, you may be able to obtain coverage from the discharger or the discharger's insurer for cleanup and legal consultant costs resulting from the contamination. If you have made a claim to your own insurance company, you must promptly report the claim to your insurer in writing. Pollution exclusion clauses might exist within your policy, but it may be possible to obtain partial coverage. Report your claim, and then contact us for a review of your policy.
- Environmental problems in commercial real estate transactions. Our firm will work with your attorney to help resolve environmental problems that arise during the course of a commercial real estate transaction. The discovery of contamination should start discussions, not end them. We will work closely with you and a qualified environmental consultant to identify the actual scope of the environmental contamination and explore solutions that can permit the buyer and/or seller to make business decisions based on dollars and cents information and accomplish the sale.
